Contractual relations imply the fulfillment by the parties of their obligations in full. If one of the parties, let’s call it the offender, violated the terms of the contract, then the victim begins to take measures to eliminate the contradictions. In most cases, the dispute can be resolved before trial, especially since in most civil law disputes it is important to follow the claim (pre-trial) procedure for their settlement, without which the arbitration court will return statement of claim back.

Typically, a “debriefing” begins with the presentation of a claim (complaint) to the offender, which is often impossible or very difficult to convey personally. The reasons may be different: the parties are geographically far from each other; the victim’s health condition does not allow him to visit the offender in person; the latter refuses to accept the claim, and so on. The post office comes to the rescue; there is a branch in almost every locality. In this article we will look at how to properly send a claim by mail, what types of mail are used for these purposes, and which one will be most preferable?

Registered letter with acknowledgment of delivery

Any registered letter is a registered mail item (RPO). This means that all stages of its passage from the place of receipt to the place of delivery to the addressee are documented (each RPO is assigned a tracking number), and the fact of delivery itself can be proven by requesting the relevant information from the Russian Post (letters are handed to the addressee with a receipt). But if suddenly the matter comes to trial, then such a request may take time and delay the consideration of the case. Therefore, it is recommended to send any letter of claim with acknowledgment of receipt.

The notification is a special postal form (for shipments within Russia - form 119), on which the recipient’s signature is placed at the time of delivery. It is sent along with the letter and then returned to the sender with a receipt, a postal stamp and the signature of the employee who made the delivery.

Notifications, like letters, can be simple or registered. A simple card will follow the path back to the sender in the same way as a simple letter - it will not be taken into account or registered anywhere, it will simply be dropped into Mailbox. A registered notification must be received by mail, but the risk of its loss will be eliminated by adding it to the documents at all stages of the process.

When registered mail arrives at the post office at the addressee's location, the letter is delivered to the address of a legal entity (the delivery procedure is determined by an agreement between it and the operator postal service) or a notice is sent to the organization's mailbox. The notice is a special form (Form 22), which is designed to inform the recipient that there is a registered postal item in his name (or company address). In this case, registered letters are delivered at post offices upon presentation of a notice, as well as a passport and power of attorney (if the recipient represents a legal entity).

By sending certified mail with notification, you will provide conclusive evidence that your application (or claim) was delivered to the recipient's address. However, here we cannot exclude the possibility that during the trial the recipient will declare that he received from the victim an envelope with a blank sheet or with completely different information, in general, he will say that he did not see the claim.

Indeed, the very fact of delivering a registered letter with acknowledgment of delivery does not mean that there really was a claim, and not a declaration of love or a wish for a long and happy life. And if the guarantee of delivery is an undoubted advantage of registered mail, then the lack of evidence regarding the attachment is an undeniable disadvantage. Therefore, in order to competently resolve controversial issues, it is better to send the application by letter with a declared value.

Valuable letter with a list of attachments and notification

A valuable letter (with a declared value) also applies to RPO and is protected from the risks of loss in transit due to the fault of postal workers. When sending such a letter, its “declared value” must be indicated - this is the amount that will be paid to the sender in the event of damage to the correspondence or its loss as a result of force majeure.

Valuable letters are delivered exclusively at post offices upon presentation of a notice. Delivery and handing over to the location of the organization or place of residence individual impossible.

Receipt of delivery, as in the case of registered mail, will indicate that the addressee has received the letter. But the problem of proving the contents of this letter will remain open. Therefore, it would be better to send a valuable letter with a description of the attachment and a receipt.

Inventory of attachments is a special postal form (Form 107), which is filled out before sending a letter (this “option” is only possible for valuable letters and does not apply to registered letters). The inventory indicates the names of the documents contained in the envelope and their quantity.

To send such a letter, you must prepare an envelope with a claim enclosed. The envelope DOES NOT need to be sealed. Fill in all the required fields on the envelope (your address and the recipient's). Fill out two copies of the inventory form f.107. This can be done on the post office website, after which they can be printed. Or take the blank printed forms directly from the branch, where you can fill them out.

In the “Name of Items” column, enter the name of your claim, for example, “Claim for refusal to return part of the insurance premium after early repayment.” In the column “Number of items” we write 1 (unit). And in the column “Declared value, rub.” enter a small amount in rubles (no more than 10 rubles).

What does a postal worker do:

  • checks the inventory with the contents of the letter;
  • puts a certification signature and seal on the inventory with the date and department index;
  • one copy of the inventory is returned to the sender;
  • the claim with the second copy of the inventory is sealed in an envelope and the reception is formalized postal item.

This way, it will be confirmed that you sent exactly the claim, and not something else or a completely blank sheet. In this case, the postal worker who certified the inventory bears full responsibility for the correspondence of the inventory to the actual attachment. The payment receipt, inventory and receipt receipt will be conclusive evidence that you sent the claim to the offender. And it will be possible to compensate for your expenses at the expense of the recipient of the letter (if, of course, the sender wins in court).

Note! To ensure that in the future the other party cannot challenge the contents of the claim letter, it is advisable to indicate the most detailed name of the attached documents when compiling the inventory. For example, “Claim with requirement”.

Even despite the presence of an inventory, the addressee may open a dispute regarding the content of the received requirement. How can you fight your opponent in this situation? It’s very simple - download the inventory form from the Russian Post website and fill it out on your computer. At the same time, the contents of the entire claim are entered in the text of the inventory in small print. Then the name of the attached document will look like this: “Claim with the following content: “.

The main disadvantage of valuable registered postal items with an inventory is the lack of a guarantee of their delivery. It is quite possible that the message will be returned to the sender with a note indicating that the storage period has expired. The main thing here is not to print out the letter, but to keep it until the trial. During the hearing, you can present the envelope to the judge for review and open it in his presence. This will be guaranteed proof that you sent “the right thing” and your good intentions.

If the recipient claims that he did not receive anything, or received, but not what you sent him, then the burden of proving these circumstances lies entirely with him. The judge in this case will probably side with the sender.

You can send any claim letters using the methods described above:

  • application to court;
  • complaints to Rospotrebnadzor, the prosecutor's office, FAS;
  • claims to the bank;
  • requirements for borrowers, etc.

How to properly send a claim by mail? Additional measures

Let us assume that all measures aimed at delivering the claim by mail have been completed. But the addressee stubbornly refuses to receive the letter. Maybe because he suspects its contents, or maybe everything is much more banal. Employees of the organization are simply too lazy to go to the post office, or, as knowledgeable people write in reviews, a legal entity. persons draw up powers of attorney for their employees only to receive registered letters (according to the standard postal power of attorney form), but unfortunately, they forget about valuable ones or are too lazy to draw them up. How can we force the other party to receive the shipment?

The first thing they recommend doing on the forums is to send a telegram following the complaint. In the text of the message you need to indicate that you sent the letter by mail and ask to receive it (just indicate the letter number). The telegram is delivered directly to the addressee, without prior notification of its arrival. Therefore, there is practically no chance that they will not receive it. This will ensure that the defendant is properly notified of the claim. And if he refuses to receive a registered (or valuable) letter, this will be regarded as a deliberate evasion of obligations.

The second option is to use the same telegram as the main means of notification. In this case, the entire text of the claim is written in the forwarded telegraph message. But this method only works fully in cases where the text size is small, i.e. takes up no more than 1 sheet. True, this method will cost a pretty penny. Alternatively, you can send only the main idea of the claim, an excerpt from it in a few words, for example: “I ask you to recalculate the insurance premium and return part of it in connection with the full early repayment of the loan.”

So what is the correct way to send a claim by mail? Which method will be most preferable? Those discussing this topic on various forums agree that nothing better than a valuable letter with an inventory and notification has yet been invented. You can try all available options with additional measures, but the most reliable way to transfer claims is still to personally deliver them to the offender (just don’t forget to get a copy with a receipt stamp; alternatively, you can prepare a second copy of the claim for these purposes). Here, the very fact of delivery cannot be disputed, and the essence of the transmitted message is not in doubt.

It is recommended to send important papers and other valuable parcels by registered mail. In this case, you will need to fill out an inventory of the investment along with a notification of delivery f. 119. You can receive such a sheet and issue it at any post office. It is intended to inform the sender that the addressee has received the letter. At the end of the article you can download an example of design in Word.

Notification of delivery of a letter has a prescribed form. Therefore, no matter which post office it was received at, the recommendations below will be relevant.

So, fill out the first side of the form as follows:

  1. At the top, check the box next to the appropriate type and category of postal item.
  2. Next, indicate the details of the sender (or another person to whom the sheet needs to be provided). Write your full name, address and zip code.

The algorithm for filling out the delivery notice on the reverse side is outlined below:

  1. Type and category of departure.
  2. Details of the recipient to whom it will be delivered (full name, address).

It is worth noting that only the addressee himself can receive a letter with a notification of delivery, having previously presented a passport.

Important! The notification sheet itself contains a hint - the fields outlined in bold must be filled out by the sender.

For a simple parcel, a notification of delivery form cannot be issued. Confirmation of receipt can only be ordered when preparing an insured item. These services are relevant when sending tax reports. It is suitable for any envelope with a valuable investment.

How to fill out a form by mail

The fields outlined in bold are to be filled in by the sender. After this, the postal worker checks the correctness of the entered data. Next, he draws up a receipt (Form 1), which simultaneously serves as both a financial and an accompanying document.

Another postal service is location tracking. To do this, tape with a barcode is glued to the envelope or plastic bag, and it is registered in the system. Later, using the identification number, it will be possible to determine where it is and guess when it will arrive at its destination.

After the postage payment has been verified, a stamp is placed on the shipment. The delivery receipt is glued to the back of the envelope or placed in a pocket if everything is packed in a plastic bag.

Receiving a letter: what the recipient needs to fill out

To pick up a parcel at the post office, the recipient needs to present an identification document. Next, he puts his signature on the notice and on the form, which will be returned to the sender.

The postal worker then puts the following marks on the back:

  • to whom it was transferred;
  • when received;
  • The addressee personally received the parcel or through a representative.

After this, the recipient enters his data - full name, address - in the “Received” line.

When the return receipt letter is delivered and the form is completed, it is submitted to the post office manager or other authorized employee for review. Then the document is sent to the return address, thereby confirming the fact of delivery.

Important! If the notification of delivery of the postal item was never sent, the citizen has the right to file a claim for failure to fulfill obligations.

A notification of delivery form can be obtained at any post office. Recommendations on how to fill it out are relevant for all regions, since this document has a prescribed form. On the first side, the sender's details and his address are indicated, where the sample with delivery marks will later be sent. On the reverse side of the completed form, information about the addressee is reflected. Next, you can download a sample form from the link.

Registered letter is a postal item intended for conducting personal correspondence, sending documents, postcards, and paper. Unlike a simple letter, a registered letter is delivered personally into the hands of the addressee or his legal representative. When sending registered written correspondence, you can use the “receipt notification” or “SMS notification” service, which will inform the sender that the letter sent to them has been delivered.

A registered letter, unlike a regular letter, is a registered mail item, which is assigned an individual track number (or in other words, a postal identifier). Using the track number on the Russian Post website, you can track the movement of a letter from the moment it is received and primary processing until the moment of issue. Information, or rather the status of the letter's status, may be displayed with some delay and inaccuracy when tracking. Therefore, you should not rely entirely on this information.

Written correspondence, like other types of mail, has a number of restrictions:

How to send

You can send a registered letter at any branch of the Russian Post. Sending is carried out through the operator.

  1. Buy an envelope of a suitable size, put the documents intended for sending into it, seal it and indicate on it the address, postal code and full name of the addressee and sender.
  2. If you need a notification of delivery, take a free form f. from the department. 119 and fill it out.
  3. Hand the envelope (and form) to the operator, indicating that you would like to send a registered letter. After that postal worker The shipment will be weighed and registered in the system.
  4. Pay for the delivery service and pick up a receipt, which will indicate a unique postal identifier for tracking.

You can send registered letters in any envelope, regardless of what letter (letter) is printed on it. Litera- This is a special sign of postage, is analogous to a postage stamp.

If you are sending registered written correspondence heavier than 20 grams in an envelope with the letter D, or a letter weighing up to 20 grams in an envelope with the letter A, then the operator will add stamps to it for the required amount, or the remaining amount will be entered through the system. The sender does not have to take any independent steps to apply stamps.

How to send a registered letter with return receipt requested

A return receipt is a special document that informs the sender of a letter that it has been delivered and handed over to the addressee or his legal representative. The document will contain the signature of the recipient and indicate the time and date of delivery. Notifications can be simple or custom. The first will be dropped into the mailbox, the second will be delivered personally.

The return receipt is a form (Form 119) that is sent along with written correspondence, and after delivery it is sent to the return address.

To send a registered letter with notification, the sender must independently fill out form f 119. The form can be picked up at any branch of the Russian Post absolutely free of charge and filled out there. Once completed, the document along with the letter is handed over to the operator.

Sample filling:

On the front side of the form, the details of the sender of the letter, who will subsequently become the recipient of this notification, are indicated.

In addition to written notification of delivery, the post office has a service SMS notifications. To use this service, you must fill out a special form, which you can ask for at the post office. The cost of one SMS message is 10 rubles.

Registered mail can be sent 1st class - this is an expedited type of delivery (air mail). For expedited delivery by plane, you will need to pay extra; the price depends on weight, shipping distance and place (region of the Russian Federation) of shipment. "First class" is most relevant for settlements, between which air communication is provided. How to send registered mail 1st class? Notify the operator of your intention. No additional documents or forms are required to be filled out.

Sending a registered letter with a list of attachments

An inventory of attachments is a special document that indicates a list of attachments in a mail item and their value. A letter or parcel with this accompanying document at the request of the addressee, at the time of receipt it can be opened in the presence of a postal employee in order to compare the contents with the inventory. In case of loss or damage to one of the items or the postal item as a whole, Russian Post pays compensation, which directly depends on the declared value.

Sending a registered letter with a description of the attachment is not possible! This service is only available for valuable written correspondence.

A valuable letter is absolutely the same as a registered letter, with the only difference - for valuable written correspondence, the declared value is indicated, and the cost of sending it becomes higher.

To send valuable written correspondence with a list of attachments, you must fill out two forms f. 107. One is sent along with the postal item, the second remains with the sender. Forms are issued free of charge at post offices; they can also be filled out online on the official website of the Russian Post and then printed.

Sample:

Sending written correspondence with declared value is carried out at any post office through an operator. On the envelope with the letter you need to indicate its value. If the item contains a description of the contents, the envelope must be sent open. The employee must check the contents with the items that the sender will indicate on Form 107.

Price for sending a registered letter and additional services

The price for sending registered written mail depends on weight. The cost of the first 20 grams is 50 rubles without VAT and 60 rubles with VAT. For each subsequent full/incomplete 20 grams of weight you will have to pay an additional 3.00 or 3.60 rubles, according to the presence of VAT.

VAT is a value added tax; in Russia, from January 1, 2019, it is 20%. Postage paid for with stamps is not subject to value added tax. That is, by paying with stamps, you can save 20%.

Type of departure Weight/characteristics Price without VAT Price with VAT
Ordered letter first 20 grams 50 60
3,00 3,60
Valuable letter first 20 grams 110 132
subsequent full/incomplete 20 grams 3,00 3,60
Notice of delivery simple 22,92 27,50
custom 56,67 68
Fee for the declared value of the letter for every full/incomplete 1 ruble 0,03 0,04

You can stick the stamps on the envelope yourself or the operator can do it for you. The latter's work is paid.

Payment for “receipt notices” with stamps has been abolished since 2019. Therefore, the tariff including VAT is relevant for all categories of users.

If an inventory of the attachment is required, then it will be necessary to “check the compliance of the attachment with the inventory of the attachment,” for which you will also need to pay.

Price for some Additional services Russian Post depends on the subject of the Russian Federation. The table below shows the tariffs in force in 2019 in the largest cities of our country.

How to send a registered letter: instructions

Often we are faced with the need to notify someone: an employer about dismissal, a seller about a complaint about the quality of a product, neighbors about the sale of a room, and in many other situations. When it comes to the need to “notify in writing,” you should know that this is a legally significant action that has corresponding consequences.

Many civil lawsuits can only be initiated after a pre-trial settlement has been completed. That is, it is necessary to prove that attempts were made to reach an agreement before going to court. What if the other party refuses to compromise or completely ignores requests? And in such cases, the law allows you to go to court. But prerequisite acceptance of the claim for consideration is confirmation that the plaintiff has properly notified the defendant.

A way to avoid trial

Is proper written notice only important to the court? Not at all! You don't want to sue, do you? Rest assured: so does the person you need to notify. Having received a written notification from you, for example, sent by a notary (more on this below), he will understand that you:

  • are ready to bring the case to court;
  • are legally literate enough to defend their interests in court.

And this is a direct path to a pre-trial resolution of the situation.

Notification form

All notifications that citizens have to deal with can be divided into:

  • notification of various state and municipal authorities;
  • legally significant messages in civil law relations.

Upon notification of the state. bodies most often use forms approved by various by-laws (administrative regulations, instructions, orders, letters from various ministries and departments).

In civil law relations, notifications are usually made in free form.

Sometimes the parties to a contract, in order to make their lives easier, make the forms of the most important notices and notifications annexes to the concluded contract.

Notification methods

Since September 1, 2013, the procedure for transferring legally significant documents is regulated by Article 165.1 of the Civil Code of the Russian Federation. A “legally significant” document can be called differently: claim, demand, notification, statement. The rule for bringing them to the addressee, approved by law, is quite flexible; it does NOT indicate:

  • required delivery methods,
  • the form in which the relevant document must be sent.

But the law states that legal consequences begin from the moment of its delivery. Accordingly, it is in the interests of the sender of the notification deliver it in such a way as to have proof of delivery to the addressee. Moreover, if a legal dispute arises, he will have to prove the fact of notification. Therefore, if you do not want to later prove in court with the help of witness testimony that - notify in writing!

The best options for written notification are those that allow you to document the receipt of this document:

  • by registered mail with acknowledgment of delivery;
  • a valuable letter with an inventory and notification of delivery.
  • courier service;
  • delivery to the addressee in person.

How to send a registered letter to Moscow

The main thing is that the weight of one letter does not exceed the established norm - 100 g (for letters to another country - no more than two kilograms). The exception to this rule is money and bank cards– postal workers themselves do not recommend putting them in envelopes. The question often arises: is it possible to enclose small objects in a paper letter? For example, jewelry, keychains, flat magnets, badges? Postal employees answer this question in the negative.

The reason is simple - when stamping an envelope or when sending/removing it through a mailbox, the envelope may tear due to the bulky item inside. However, senders who have had some success sending small items in letters claim that such attachments can be transported as long as the items cannot be clearly felt in the envelope.
