General provisions

1. The Main Directorate of Architecture and Urban Planning of the Moscow Region (hereinafter referred to as the Main Directorate) is the central executive body of state power of the Moscow Region with special competence, carrying out executive and administrative activities on the territory of the Moscow Region in the fields of architecture and certain areas of urban planning activities, implementing state policy in these areas .

Goals and main tasks of the Main Directorate

10. The Main Directorate was created to implement the state policy of the Moscow region in the fields of architecture and certain areas of urban planning activities on the territory of the Moscow region.

11. The main tasks of the Main Directorate are:

providing urban planning tools for the spatial development policy of the Moscow region and creating conditions for sustainable urban development, improving the quality of life of the population, economic growth of the Moscow region, for creating modern social, industrial, engineering and transport infrastructures;

formation of the modern architectural appearance of the complex development of cities, settlements and other settlements, natural and landscape environment, including ensuring the preservation of cultural heritage in the interests of living and future generations;

creating conditions for the effective functioning of organizations that are departmentally subordinate to the Main Directorate.

20. The Main Directorate, within its competence, participates in the prescribed manner in carrying out verification activities in relation to state civil servants of the Moscow Region, serving in the state civil service of the Moscow Region in the Main Directorate, who are allowed to access state secrets.

21. The Main Directorate carries out measures provided for by law to limit the rights of state civil servants of the Moscow Region serving in the state civil service of the Moscow Region in the Main Directorate, and provides social guarantees to persons who have or have had access to information constituting a state secret.

22. The Main Directorate, in accordance with the legislation of the Moscow Region, forms proposals on the volume, nomenclature and projected cost of purchased goods, works, services to support the activities of the Main Directorate, as well as financial support specified purchases at the expense of the budget of the Moscow region and extra-budgetary funds.

23. The Main Directorate, in accordance with the established procedure, maintains, in accordance with its competence, a set (list) of regulatory legal acts and contracts and agreements concluded on behalf of the Moscow Region, providing for the emergence of expenditure obligations of the Moscow Region, indicating the amount of budgetary funds necessary for their implementation.

24. The main administration is carried out within its competence and in accordance with the law Russian Federation placing orders for the supply of goods, performance of work, provision of services to support the activities of the Main Directorate.

25. Orders of the Main Directorate for the Protection of Human and Civil Rights and Freedoms are subject to official publication in the newspaper "Daily News. Moscow Region".

26. The main department may be renamed, reorganized or abolished in accordance with the legislation of the Russian Federation and the legislation of the Moscow region.

Committee for Architecture and Urban Planning of the City of Moscow(Moskomarkhitektura) - the executive authority of the city of Moscow, authorized in the field of urban planning and architectural activities, performs, within its powers, executive-administrative, coordination and other functions of public administration and regulation in the field of urban planning and architectural activities in the city of Moscow. Control over the activities of the Committee is exercised by the Moscow Government. The activities of the Committee are led by the Chairman of the Committee, the Chief Architect of the city of Moscow.

General provisions

1. The Main Directorate of Architecture and Urban Planning of the Moscow Region (hereinafter referred to as the Main Directorate) is the central executive body of state power of the Moscow Region with special competence, carrying out executive and administrative activities on the territory of the Moscow Region in the areas of improving the architectural and artistic appearance of cities, settlements and other settlements, architecture and certain areas of urban planning activities that implement state policy in these areas.

2. The Main Directorate is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, legal acts of the President of the Russian Federation and the Government of the Russian Federation, the Charter of the Moscow Region, laws of the Moscow Region, acts of the Governor of the Moscow Region and the Government of the Moscow Region, international treaties of the Russian Federation and agreements of the Moscow Region on the implementation of international and foreign economic relations, these Regulations, as well as other legal acts by Decree of the Government of the Moscow Region dated May 12, 2009 N 370/19.

3. The Main Directorate carries out its activities both directly and in interaction with federal executive authorities, other central and territorial executive authorities of the Moscow region, state bodies of the Moscow region and state institutions of the Moscow region formed to implement certain functions of public administration of the Moscow region (hereinafter referred to as state bodies of the Moscow region), local government bodies of municipalities of the Moscow region (hereinafter referred to as local government bodies), organizations regardless of their form of ownership and legal form.

4. The main department has the rights of a legal entity; has an independent balance sheet, personal accounts opened in accordance with the law, a seal with a reproduction of the coat of arms of the Moscow region and with its name, other seals, stamps and forms necessary for the implementation of its activities; may, on its own behalf, acquire and exercise property and personal non-property rights and obligations.

5. The activities of the Main Directorate are financed from funds provided in the budget of the Moscow region.

6. The Main Directorate has the property necessary for the exercise of its powers, which is owned by the Moscow Region and assigned to the Main Directorate with the right of operational management (clause as amended, put into effect by Decree of the Government of the Moscow Region dated May 12, 2009 N 370/19.

Powers of the Main Directorate

12. The Main Directorate exercises the following powers:

12.1. Preparation of proposals to the Government of the Moscow Region:

on approval of territorial planning documents of two or more constituent entities of the Russian Federation, territorial planning documents of the Moscow region and amendments to territorial planning documents of two or more constituent entities of the Russian Federation, territorial planning documents of the Moscow region;

on the joint preparation of draft territorial planning documents by the Government of the Moscow Region, federal executive authorities, executive authorities of constituent entities of the Russian Federation that have a common border with the Moscow Region, local government bodies;

on approval of documentation on territory planning for the placement of capital construction projects of regional significance, as well as documentation on territory planning prepared on the basis of territorial planning documents of two or more constituent entities of the Russian Federation, territorial planning documents of the Moscow region;

on the approval of the draft territorial planning scheme of the Russian Federation and on the preparation of a consolidated conclusion on the territorial planning scheme of the Russian Federation;

12.2. Participation in the preparation of draft regulatory legal acts of the Moscow Region, defining the policy of socio-economic development of the Moscow Region in order to take into account in them the requirements of regulatory legal acts of the Moscow Region, defining the policy of spatial development of the Moscow Region;

12.3. Ensuring consistency of territorial planning documents of two or more constituent entities of the Russian Federation, territorial planning documents of the Moscow region, territorial planning documents of municipalities of the Moscow region, territory planning documentation;

12.4. Ensuring, in cases and in the manner provided for by the legislation of the Russian Federation and the Moscow Region, coordination with the authorized federal executive bodies, the highest executive bodies of state power of the constituent entities of the Russian Federation that have a common border with the Moscow Region and local governments of municipalities of the Moscow Region of territorial planning schemes for two and more subjects of the Russian Federation, draft territorial planning schemes for the Moscow region.

Preparation of proposals for the formation of zones with special conditions using the territories of the Moscow region to take them into account in the territorial planning documents being developed for two or more constituent entities of the Russian Federation, territorial planning documents of the Moscow region;

12.8. Registration and storage of materials of the General Development Plan of the Moscow Region, including source and supporting materials;

12.9. Ensuring the preparation of documentation on territory planning for the placement of capital construction projects of regional significance, making decisions on the preparation of documentation on territory planning based on territorial planning schemes of two or more constituent entities of the Russian Federation, territorial planning schemes of the Moscow region;

12.10. Ensuring the preparation and approval of urban planning assignments for the preparation of territorial planning documents, documentation on territory planning;

Preparation of opinions on the possibility of using forest fund areas and approval of documents justifying the possibility of using forest fund areas in accordance with territorial planning documents of the Moscow Region when preparing documentation on the transfer of forest fund lands to lands of other categories;

12.13. Preparation of opinions in accordance with territorial planning documents of the Moscow region on the possibility of using land plots to which urban planning regulations do not apply or for which urban planning regulations are not established;

12.14. Preparation and submission of proposals to the commission for the preparation of draft land use and development rules on amendments to the land use and development rules, if the land use and development rules may impede the functioning and placement of capital construction projects of regional significance;

12.15. Coordination and preparation of conclusions on the possibility of transferring land from one category to another;

12.16. Coordination of the placement of capital construction projects of regional significance, including housing, civil, industrial, industrial, funeral and other facilities;

12.17. Organization, in accordance with the legislation, of the development of architectural projects for capital construction projects located in accordance with the territory planning documentation approved by the Government of the Moscow Region;

12.18. Approval of architectural and planning assignments for the construction (reconstruction) of objects within the boundaries of the zones of planned placement of capital construction projects of regional significance, the construction of which is carried out at the expense of the budget of the Moscow region;

12.19. Conducting architectural competitions in accordance with the legislation of the Russian Federation and the Moscow region and ensuring the conduct of pre-design studies for the development of projects for unique and particularly important architectural capital construction projects, natural landscape complexes, cultural heritage sites (historical and cultural monuments) of regional significance, the construction of which is carried out at the expense of budget of the Moscow region;

12.31. Ensuring objective, comprehensive and timely consideration of citizens' appeals on issues within the competence of the Main Directorate, and giving written answers to them in the manner prescribed by law;

12.32. Providing mobilization preparation and mobilization activities on issues within the competence of the Main Directorate;

12.33. Concluding, within its competence, agreements with organizations on the supply of products, carrying out work, allocation of forces and resources, and provision of services in order to ensure mobilization training;

12.34. Implementation of measures for civil defense and protection of the population, prevention and liquidation emergency situations, ensuring fire safety in the Main Directorate;

12.35. Participation in the prescribed manner in the implementation of activities in the Main Directorate for Countering Terrorism and Extremism;

12.36. Adoption, on issues within the competence of the Main Directorate, of legal acts of a normative nature - orders that are valid throughout the Moscow region and are mandatory for government bodies of the Moscow region and government institutions of the Moscow region, as well as local government bodies, legal entities and individuals.

13. The Main Directorate exercises other powers provided for by law.

Ensuring the preparation of documentation on the planning of the territory on the basis of master plans, rules of land use and development of settlements, urban districts (without taking into account master plans and rules of land use and development in cases provided for by federal laws), as well as on the basis of territorial planning schemes of municipal districts, if such documents provision is made for the placement of linear objects of local importance.

14.3. Interact with the Russian Academy of Architecture and Construction Sciences, research and scientific organizations, educational institutions, participate in the activities of public organizations and professional communities;

14.4. Develop and approve methodological materials, instructions, recommendations and other materials on issues related to the areas of activity of the Main Directorate;

14.5. Conclude agreements with local governments on interaction on issues within the competence of the Main Directorate;

14.6. To involve, in the prescribed manner, research, technological, design and other scientific organizations, as well as specialists and experts, including foreign ones, in the development of proposals for improving management in areas related to the activities of the Main Directorate and the implementation of scientific research work;

14.7. Being, in accordance with the legislation of the Moscow Region, the main manager of budget funds of the Moscow Region, to act in court, arbitration court on behalf of the Moscow Region as a representative of the defendant in claims against the Moscow Region:

on compensation for damage caused to individuals and legal entities as a result of illegal actions (inaction) of the Main Directorate or its officials, including as a result of the issuance of acts of the Main Directorate that do not comply with the law or other regulatory legal act;

14.8. Apply in accordance with the established procedure to the court, arbitration court in defense of public interests in cases provided for by law;

14.9. Representatives of the Main Directorate may, in accordance with the established procedure, be members of the boards and commissions of other central executive bodies of state power of the Moscow Region, state bodies of the Moscow Region, as well as federal executive bodies, temporary creative teams.

Organization of the activities of the Main Directorate

16. The Main Directorate is headed by the Head of the Main Directorate for Architecture and Urban Planning of the Moscow Region (hereinafter referred to as the Head of the Main Directorate), appointed and dismissed by the Governor of the Moscow Region.

The Head of the Main Directorate is personally responsible for the implementation of the tasks assigned to the Main Directorate and the exercise by the Main Directorate of its powers.

18.10. Ensures timely and high-quality work to bring regulatory legal acts of the Moscow Region on issues within the competence of the Main Directorate into compliance with newly adopted federal regulatory legal acts and (or) regulatory legal acts of the Moscow Region;

18.11. Develops and submits for approval to the Government of the Moscow Region a draft Regulation on the Main Directorate and staffing levels (paragraph as amended by Resolution of the Government of the Moscow Region dated June 8, 2012 N 786/19.

The staffing table of the Main Directorate, as well as changes to it, is approved by order of the Main Directorate within the limits of the staffing level and wage fund approved by the Government of the Moscow Region;

12.18. Approves the cost estimate for the maintenance of the Main Directorate within the limits of the funds provided for by the law of the Moscow Region on the budget of the Moscow Region for the corresponding financial year;

18.13. Appoints to positions of the state civil service of the Moscow region, transfers and dismisses from the state civil service of the Moscow region state civil servants of the Moscow region serving in the state civil service in the Main Directorate; concludes and terminates service contracts with them; applies incentives and disciplinary measures to them as a representative of the employer; resolves, in accordance with the law, other issues related to their performance of the state civil service of the Moscow Region in the Main Directorate;

18.14. Hires, transfers and dismisses other employees of the Main Directorate, concludes and terminates employment contracts with them, applies incentives and disciplinary measures to them; exercises other powers of the employer provided for by law;

18.15. Makes, in accordance with the established procedure, proposals for awarding particularly distinguished civil servants of the Moscow Region, serving in the state civil service in the Main Directorate, and other employees of the Main Directorate, as well as other persons in cases provided for by the legislation of the Moscow Region, state awards, awarding them state prizes and conferring honorary titles, coordinates proposals for awarding local government officials and municipal employees in local government bodies with awards in the Moscow Region;

18.16. Awards letters of gratitude, certificates of honor and diplomas of the Main Directorate;

18.17. Manages financial resources and property assigned to the Main Directorate in the manner prescribed by law;

18.18. Coordinates in the prescribed manner the appointment and dismissal of heads of subordinate state unitary enterprises of the Moscow region, coordinates the charters (regulations) of these organizations, conclusion and termination employment contracts with their leaders;

18.19. Appoints and dismisses from office in the prescribed manner the heads of subordinate government institutions of the Moscow Region in agreement with the Ministry of Property Relations of the Moscow Region, approves their charters;

18.20. Organizes compliance in the Main Directorate with the regime for the use of documentation containing information constituting state secrets, as well as information of a confidential nature;

18.21. Organizes civil defense activities in the Main Directorate;

In the Main Directorate, under the head of the Main Directorate, advisory and consultative bodies (councils, commissions, working groups) may be formed from among representatives of the Main Directorate, other executive bodies of state power of the Moscow Region, state bodies of the Moscow Region for preliminary consideration of the main issues of the activities of the Main Directorate and preparation of regulatory legal and other documents.

The composition of these bodies and regulations on them are approved by the head of the Main Directorate. Organizational and technical support for the activities of these bodies is carried out by the Main Directorate.

20. The Main Directorate, within its competence, participates in the prescribed manner in carrying out verification activities in relation to state civil servants of the Moscow Region, serving in the state civil service of the Moscow Region in the Main Directorate, who are allowed to access state secrets.

21. The Main Directorate carries out measures provided for by law to limit the rights of state civil servants of the Moscow Region serving in the state civil service of the Moscow Region in the Main Directorate, and provides social guarantees to persons who have or have had access to information constituting a state secret.

22. The Main Directorate, in accordance with the legislation of the Moscow Region, forms proposals on the volume, nomenclature and projected cost of purchased goods, works, services to support the activities of the Main Directorate, as well as on the financial support of these purchases from the budget of the Moscow Region and extra-budgetary funds.

23. The Main Directorate, in accordance with the established procedure, maintains, in accordance with its competence, a set (list) of regulatory legal acts and contracts and agreements concluded on behalf of the Moscow Region, providing for the emergence of expenditure obligations of the Moscow Region, indicating the amount of budgetary funds necessary for their implementation.

24. The Main Directorate carries out, within its competence and in accordance with the legislation of the Russian Federation, the placement of orders for the supply of goods, performance of work, provision of services to ensure the activities of the Main Directorate.

25. Orders of the Main Directorate for the Protection of Human and Civil Rights and Freedoms are subject to official publication in the newspaper "Daily News. Moscow Region".

26. The main department may be renamed, reorganized or abolished in accordance with the legislation of the Russian Federation and the legislation of the Moscow region.
